Who lets you resell LLM API access? Provider rules in 2026

Many sites sell “access to GPT and Claude” for crypto. Before you trust one, or build one, read what the model makers write about it. This dataset quotes the terms of 15 model makers and inference hosts, and the licences of the main open-weight models, with links and the date we read each page.

Quick answer

Can you resell access to the OpenAI, Claude or Gemini APIs?

Not without the provider's approval. In the terms read on 22–23 October 2026, OpenAI bans selling API keys and will require “prior review and approval” for model-access intermediaries from 20 November 2026; Anthropic allows resale only “as expressly approved”; Google, xAI and Cohere forbid it. Open-weight models under Apache 2.0 or MIT licences may be served as a paid API. LLMwithCrypto serves only those.

What does each provider allow?

“Reselling raw access” means a gateway where customers send their own prompts to a named model, paid per token. “Building a product” means your own app or agent that calls the API for its users. Read on 22 October 2026 (OpenAI, Anthropic, Google Gemini) or 23 October 2026 (the others).

Which open-weight licences allow a paid API?

Serving a model as a paid API is a form of distribution in most licences. These are the licences as read on 23 October 2026.

Where are the closed model APIs unavailable?

Each provider publishes the countries it serves. A gateway that resells their models must keep users from the others out, which a service without identity checks cannot do.

Lists read on 22 October 2026. Anthropic's page carries the label “Effective Nov 12, 2026”.

Why can a service without identity checks not resell GPT or Claude?

Because the makers forbid serving people in the countries they leave out, and a seller who never asks who you are cannot tell where you are.

  • OpenAI: “Customer and End Users may not access or offer access to the Services outside of the Supported Countries and Territories.” (Services Agreement §16.12)
  • Anthropic: its regions policy covers “use by persons while physically located in an unsupported region”, and its usage policy bans providing access “through unauthorized means”.
  • OpenRouter: no access to restricted models “by using virtual private networks and proxies”.

Blocking by IP address is the least a reseller can do, and a VPN gets around it. Sanctions law applies on top of the providers' own lists.

Is there a route the providers allow?

Four, from the pages read:

  1. Run open-weight models yourself under a permissive licence and sell per-token access. The licences above allow it.
  2. Sell your own inference on OpenRouter as a provider, through its application form.
  3. Build a real product on any API, such as an agent or a writing tool, without exposing raw model access.
  4. Sign a reseller agreement with the maker. OpenAI, Anthropic, Google and Mistral mention such channels; their terms were not read.

Only open-weight models whose licences allow serving them as an API: DeepSeek, Qwen, gpt-oss, Mistral, Llama, Gemma and others listed on the models page. We run them on GPUs we rent and operate. We do not sell access to GPT, Claude, Gemini or Grok: their makers forbid reselling API access without their approval, and we do not have it. Each model keeps its own licence and use policy (for example Meta’s Llama Acceptable Use Policy and the “Built with Llama” notice); using a model through us means accepting them.

How was this dataset built?

  • Pages: each provider's own terms, usage policy, supported-countries page and model licence, read in full on 22 October 2026 (OpenAI, Anthropic, Google Gemini) or 23 October 2026 (everything else).
  • Quotes: copied from the page text, under 25 words. Spot-check them before relying on one: terms change.
  • Gaps: Groq's services agreement could not be opened; the reseller programmes of OpenAI, Anthropic, Google and Mistral were not read; Anthropic's, Google's, Mistral's and DeepSeek's own payment methods were not checked.
  • Licence: CC BY 4.0. Reuse it with a link to this page.
